By reserving a yacht or using our services, you consent to these Terms. Do not use the Service if any part of these terms is not in agreement with you.

2. Service Overview

SmartFinancialAdvice offers top-of-the-line yacht charter services that include, but are not limited to:

  • Yacht rentals for the day
  • Evening yacht cruises
  • Business retreats
  • Private gatherings
  • Charters spanning multiple days

Service availability depends on a variety of factors and we retain the right to alter or halt any service without prior notice.

3. Booking and Reservations

3.1 Booking Process

When you wish to secure a charter, you are required to:

  • Have reached the minimum age of 18 years
  • Submit information that is both accurate and complete
  • Deposit the necessary amount as stated in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only when payment has been made and our confirmation has been issued in writing. We reserve the prerogative to decline service to any person at our discretion.

3.3 Availability

Vessel availability for charters is conditioned upon suitable weather and we shall exert reasonable efforts to accommodate your desired dates and times.

4. Payment Terms

4.1 Pricing

Our charter costs are expressed in € and include all relevant taxes unless specified otherwise. Prices may undergo changes with no prior announcement.

4.2 Payment Schedule

  • Initial deposit: 50% of the full charter fee is required upon reservation
  • Remaining balance: Due 48 hours before the departure of the charter
  • Any incidental fees (if applicable): Payable following the charter’s conclusion

4.3 Payment Methods

Accepted methods of payment include major credit cards, direct bank transfers, and certified cheques. All transactions are processed via secure and encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • If cancelled more than 72 hours prior to departure: Full reimbursement minus transaction fees
  • If cancelled within 24-72 hours of departure: 50% of the payment is refunded
  • If cancellation occurs less than 24 hours before departure: No reimbursement will be provided

5.2 Weather Cancellations

Should our captain deem weather conditions unsafe, we will suggest to:

  • Move your charter to an alternative date at no extra charge
  • Issue a full refund if rescheduling is not feasible

5.3 Mechanical Issues

In case your designated vessel encounters mechanical issues, we will strive to supply an appropriate substitute. Should we be unable to provide a substitute, you will receive a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are expected to:

  • Heed all instructions from the crew
  • Utilize safety gear as necessary
  • Disclose any medical conditions that may influence their safety
  • Stay within authorized areas on the boat

6.2 Prohibited Items

The listed items are forbidden on board:

  • Containers made of glass
  • Illegal materials
  • Weapons or firearms
  • Non-alcoholic drinks beyond moderate personal consumption
  • Pets (without previous authorization)

6.3 Conduct

Guests should act respectfully at all times. Should guest behavior create a safety concern or interrupt the enjoyment of other individuals, we maintain the right to conclude the charter prematurely and without refunding any fees.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the costs you have paid for your charter. We are not accountable for:

  • Injuries to oneself due to individual disregard
  • The disappearance or destruction of personal belongings
  • Indirect or punitive damages of any sort
  • Delays attributed to weather or events outside our control

7.2 Insurance Coverage

We provide comprehensive insurance for our fleet and operations. Clients are recommended to have their own travel and personal insurance.

7.3 Assumption of Risk

Participation in our yachting services signifies that you understand the inherent risks involved with maritime activities and you agree to take responsibility for your own security and safety.

8. Modifications and Itinerary Changes

We hold the right to adjust itineraries, paths, or schedules as necessary due to weather conditions, safety concerns, or operational demands. We will aim to offer suitable alternatives when possible.

9. Force Majeure

We shall not be held liable for any delay, amendment, or cancellation caused by events beyond our influence, which include, but are not limited to:

  • Extreme weather events
  • Catastrophes of nature
  • Mandates from the government
  • Harbor closures
  • Unforeseen technical failures

10. Privacy and Data Protection

We handle your personal data in alignment with our Privacy Policy. By engaging with our services, you grant consent for the gathering and employment of your data as outlined in the Privacy Policy.

11. Intellectual Property
